  • Executor Funds

    Good evening
    1 x executor uses solicitor number 1
    3 x executors use solicitor number 2
    all based in Scotland

    quick question
solicitor number 1 holds all funds for the estate
can 3 x executors using solicitor number 2 remove funds from solicitor number 1 to their solicitor number 2?
    and
If yes how do we do this?

solicitor number 2 not advised of this yet, so does not know about it.

Caution to start with - the following is based on a hazy memory of the law as it would have been 25 + years ago when I did my law degree (I have not practised in this area). I think the answer to this will be linked to what the law deems a quorum of the executors to make a decision. This could be a simple majority but may not be. Best advice - just ask your solicitor
