  • Executor Lied about deed of variation amounts

    A family member was responsible for executing the deed of variation for the beneficiaries however she lied. In the end she held money for 18 months, said she would pay tax and basically transferred a net amount without paying tax. In the end the net amount was approx 60% of the full amount which was agreed in the DoV.The tax outstanding tax had to be covered by the amount transferred. The DoV was agreed and signed correctly. Is this fraud? I am told that this is allowed by the family member & should be grateful & accept what I’m giving. This sounds very unfair & wrong.

    Can you clarify the position please?

    I think you are saying that the deceased left a will, but some (or all) beneficiaries agreed a deed of variation.
    The executor then failed to pay the IHT due but claimed she had and only transferred* 60% of the legacy.
    The beneficiary(ies) then had to pay IHT on the legacy.

    If that is correct, before commenting we would need to see the wording of the will and the deed of variation

      That is correct. The beneficiaries where family members & the DoV specified % of estate for each member. The executor was one of the beneficiaries & family members as well & took responsibility for releasing funds & paying IHT. *How do I get a copy of the DoV to you?*
