    hi everybody. i have been having major problems with 3, culminating in a very angry 3 customer services representative at their executive offices in maidenhead ranting down the phone at me, he said that 3 are not covered by the consumer credit act, and that i can do nothing about it, there must be a way that they come under the wing of the credit act.
    would appreciate any suggestions...........bigpaddy

      Well unfortunately he is correct, they are not covered by the CCA 1974.

      Perhaps you could expand further on your problem.

        hi everybody. my problems with three started when i asked them if they would consider ending my two agreements early, i have been with 3 since the days of them sharing lines with 02. i wrote to them when i was taken ill and had to finish work. (mental health problems, heart problems,and i have polyps in my intestines,some which are non cancerous, but at a 50-1 gamble some are going to be cancerous. i will find out next month.)i explained to three what had happened and at first they where helpful, then they started to give me the run around. i sent them three letters in the begining, they never got them. so i sent them again, they got the 1st&3rd letters but not the second which was the most important one. then the phone calls started, it got that bad that my son e-mailed the executive office to ask why these people are harassing me.he was told that they hadnt recieved the letters, my son then sent them copies of all three letters, e-mails and other correspondence to the, ceo,the finance director, customer services, collections and a very nice lady in the executive office. i got one reply, from the lady in the executive office. his led to a phone call from some guy who was at first very hepful, he said that he would put a flag on my account stopping all contact for one month to give me some breathing space. but on the 1st,2nd,23rd & 24th of this month i have been contacted by collections. no body would tell me how long i had been with three, so i sent them a cca, i didnt know that they are not covered by the cca, but i was told that last night, this guy who phoned me was the guy who at first was very helpful, he told me that the CCA couldnt touch them, i asked him if 3 were above the law and he said yes, he said he had tried to help me but no more, so i expect the full wrath of 3 to hit me very soon. regards. bigpaddy

          If you have a contact at the Executive Offices, then correspond directly with them. You are wasting your time speaking to anyone in a call centre.

            Hi these guys at three obviously think they are it, therefore you need to be a little more imaginative..... their agreements may not be covered by the CCA, but they still have to comply with both the OFT's Guidelines re debt collecting and the Data Protection Act!

            If they have entered a defaut on your CRF file and the account is in dispute, then they breach ths DPA and you can theorically claim damages from them due to the effect of the entry of the default on your reputation......

            or

            if they are telephoning you at all hours and repeatedly - when you have asked everything to be in writing, then they are breaching the OFT's guidelines and possibly the harassment laws.... send them a letter demanding they stop harrassing you (by registered post) and complain to the OFT .... it's very easy... they might not take much notice but depending on how far you wish to take these matters both will come in handy if and when it comes to court...... letters with POD are good evidence for a court! you have no evidence of any shouting match! no matter how right you might be!

              I would add to your post James that the individual should keep a log of all calls for the aforementioned company as proof as well, something simple like date/time/telephone number(unless private).

                i went through the thread and saw that there are quite a few disgruntled people and felt better that it was just not me !
                i am on a 18 month contract with three and am a very good customer , infact its my second round of contract .. so been with three for more than 2 years.
                My usage is nominal and never come close to using my entire 300 minutes .
                recently i was in india and suddenly i get text that my mobile bill is very high and that i should check , on logging in 3 website i saw that i was being charged £ 146.00 for a roaming call from india to UK with the call lasting 112 minutes. Now i never made that call and do not understand how it could last that long . Even if the number got pressed by mistake , the person on the other end would never hold on to it for 112 minutes . so i cancelled my dd and then the calls from 3 started ... each time a new person and each time i would explain that i di not make the call and they should check with the local indian network ( IDEA) on whose network i was . They kept saying that they have checked and insist the call is genuine.
                They however waived off 50 % but still want £ 70 ,00 from me .
                My services were then restricted and when i spoke to one consultant he agreed that i pay the line rental and that there was only an outstanding of £ 9.00 , i thought now that is fine and i promptly paid off and my services were restored and reinstated my DD.

                But this was not to be the case and they still tell me there is an outstanding and i have cancelled my DD again and they have again restricted my services.

                I am now quite perplexed and do not wantto give in . I have written a complains letter to their Glasgow address SD but no reply so far ... someone has rightly said that the consultants in india have limited powers and can only do as much and no one wants to find any solution.
                sorry for such a long mail .. but can anyone advise on what to do next ... i would happily give up three and go on Pay as u go but guess they will not give me the PAC till my contract is over .

                    I have also had problems with Three mobile.
                    In november 2007 i was sent a new phone after having been with Orange for the previous contract. I had a 14 day window in which to return the phone if i was unsatisfied, which i was....i tried on several occasions to call the number on the invoice to obtain a goods return number, sometimes waiting over 5 minutes...the phone just rang with no reply!
                    I decided to just send the phone back to the store from which it had been sent by recorded delivery with a letter explaining the situation. A few weeks later the package was returned to me by the Royal Mail stating that the address was unoccupied. During this 14 day acceptance period, the phone store had moved premises!!!
                    Due to the fact that the issue was unresolved within that 14 day period, the contract began with Three and they pressured me to pay 3 monthly installments, even though i'd sent the phone back to the independant store after finding their new address. I even got a rude phone call from the store itself asking why Three were contacting them. Before i could get any information, the phone was slammed down on me!

                    Since then, ive had 3 different solicitors contact me, threatening to send their people to my home to reclaim the money. Luckily i kept an original email that i sent to Three in DECEMBER 2007, less than one month after i tried to return to the phone, explaining what had happened. I have forwarded this email to every solicitor that wrote to me, and they refuse to take matters further because of the dispute. I have not heard back from Three in the last year, but the situation still remains unresolved. I have been worried in the past with the fear of bailiffs turning up at my house all for the sake of 105 pound!!!

                    I took every step i could to return the phone within the 14 day period and yet i had to cope with the stress of constant phone calls and solicitors letters demanding money for two years.
                    Three may well have made the decision to forget it, but the shadow still hangs over me and theres always the fear that it may re-surface in the future. Can anyone give me advice on the best course of action, if any?!

                      OP - sorry, about to take daughter to dentist, so in a rush and have not read whole thread. We have 6 contracts with 3 which they've very kindly paid for us for the past 5 months now due to cock ups and the front line staff being unwilling to move.

                      I now ignore them and go straight direct line number to CEO. E-mail him if you have problems with 3's customer service who are useless. I cancelled all 6 contracts and said I'd see them in court, then e-mailed the CEO and all happily sorted. They get the bill wrong every month (computer error), I phone CEO, balance set to zero no quibbles, computer gets it wrong the next month and so it goes on. Happy days!
