  • Sim Swap Fraud Tesco Mobile

    My Mobile account was fraudulently accessed and the fraudster got my puc code and did a sim swap and ported my number to a different network, then proceeded to access my email accounts changed password and banks etc. the fraudster had control of my emails , I went to mobile shop to see why I had no access to my network and the assistant had a look on their mobile server and to see what happened and I saw some of the correspondence between the Sim thief and the provider, The security questions asked where replied with wrong answers they asked for my place of birth and address both WRONG But they still released sim and ported to a new provider, I sent a letter and they admit breach of DPA and sent a letter admitting liability with a lousy offer of 250.00 which I refused, I spend around 30 hours securing my accounts trying to get my phone number back (I have) and sleepless nights stopping my banks being emptied So far I have recovered lost funds and everything is now secure. My claim is for stress breach of my data and time and money spent recovering and securing my personal data. Plus the Fraudster has all my personal details DOB, Address, Mother maiden name all my NI No. Is there a solicitor who will take this on NWNF or can I do this my self ?

    Write to them, explain that the compensation offered doesn't reflect the seriousness of the data breach, explain what you've had to do to try to rectify the breach i.e. change passwords etc.

    Explain that if it isn't resolved you will take further action. Explain the stress / anxiety this has caused you. If you lodged a Claim through the Courts, they wouldn't take into consideration 'stress'. You could run this pass the ICO, see what they say.

    Not to make light of this, but there are so many 'breaches of data', you are not alone.

        It's fine, I think you may need to do some 'negotiating' with them.
        You've highlighted their failures and worked out the compensation you seek.
