  • Voluntary Termination

    Morning. Looking for some assistance, I’ve sent the email for voluntary termination of a car finance agreement as I’ve paid over the 50%. The email itself was sent on the 1st of march and they sent back the automated thank you for getting in contact email. It’s now been 10 days and they’ve still not replied. Further to this they’ve taken a payment yesterday for the car. Am I within my right to request this back through direct debit indemnity and cancel the the direct debit?

    Yes, providing you've paid 50%.

      Further update. It’s now been 17 days since the termination email was sent. Still no reply. We’ve called them and they said they’d get one of their “vt” team to call back within 48 hours, it’s now been 72. They’ve argued the direct debit indemnity with my bank saying they’ve provided sufficient evidence that the direct debit was due. What are the options now?

        Get evidence from your bank that you've paid over 50%. It might take a bit of time, send your bank a Subject Access Request.

        Lodge a formal complaint with the finance company, they will have a complaints procedure on their website.
        No doubt they will come back to you fairly quickly.

          Little update. As of the 19th they tried to make us sign a VT slip from them. On that slip that it says that they’ll arrange collection within 2 weeks, but I refused to sign it stipulating that I gave them written notice on the first. They acknowledged this a day later on the 20thThey’ve refunded the payment they took on the 10th but as of yet they’ve yet to make an attempt to collect the car. The MOT ran out at midnight last night which the say will cause a failed collection (when ever they decide to collect)

          when can I fill out the v5 and put them as registered keeper and cancel the insurance and tax.
