  • Nissan VT - they're saying I need to Mot the car next month next month

    Hello, I've sent an email to Nissan Finance to Voluntarily Terminate my agreement. They want me to sign forms before booking a collection. Additionally, the Mot is due in 25 days (it was 27 days when I sent the email) and they're saying that I'll probably need to put it through an mot because the collection might be later than that. Is this right? And do I have to sign their forms before booking a collection?

    Welcome to LB

    1) Go through their Terms and Conditions, the Terms and Conditions might be 'unfair'.

    2) You don't have to 'sign' any forms, but again refer to their Terms and Conditions.

      VT is a statutory right and your only obligations are to

      1) give them notice of termination,
      2) pay at least 50% of the total payable and
      3) to have taken reasonable care of the vehicle.

      If you have abided by all three obligations and the termination date you gave them is before the MOT expires then you are in the clear. If you have not given notice then do it now for 7 or 10 days time so that the contract expires before the MOT is due.

      Do not sign anything, remind them that VT is a statutory right, you have met your obligations and irrespective of when they actually collect the vehicle, it and its MOT is for them to sort out once the termination date has passed.
