    IMO you should send it now. FOS won't be so quick to allocate your complaint to an investigator that you won't have a chance to add to your complaint

      Well that’s the car collected.

      condition report said good and of course I refused to sign. Now let’s see what figure start line come out with for damages.

        Did you take photos of the car inside and outside before it was collected?

          Pezza54 yeah got 150 images in total of exterior and interior including all service and mot history user manuals 2 keys the lock & wheel nut etc as well as a video of everything

          can see it already listed on an auction site unfortunately only traders can view, no images as of yet and no grade put on it yet.

            echat11 Pezza54 need more advice from you guys.

            the car got collected on Wednesday and today it’s listed on the action house site with grading (not the best grade) now all damage that was there is still there in the pictures so my question is when should the finance company be requesting payment for damage? I thought any bill would be to cover fixing these items in order to sell the car but clearly they are going ahead to sell first.

            would they be doing this to then see what the car sells for then try make up the difference of what they’ve lost compared to the sale at auction price if that makes sense. So I’d likely get a bill after the auction takes place?

              Your contract is terminated. How the finance company disposes of the car is up to them
              You are responsible for paying reasonable costs of making good damage above fair wear and tear
              If you have photos of the accident damage you could obtain garage estimates/quotations for repair in case the fc claim for damage repair is far too much

                echat11 Pezza54 so thought I’d give you guys an update.

                startline have came back to me with a bill of £600+, their breakdown is 300 for the arrears (since they wanted to keep up payments until collected and then 350 for damages beyond wear and tear.

                they have said auction attribute £1319, any idea what this means? Does that mean the car only sold for this at auction or that’s what shortfall is left from what was due

                I have told them that I will not be paying the 300 for final payment as I terminated with immediate effect the car wasn’t used and the only reason it wasn’t collected before final payment was availability from their recovery agents they employ but I have agreed to the damages. I’ve asked them to reconsider their stance before it goes to the financial ombudsman which will delay payment for damages until the case is resolved.
