  • VT Black Horse- ‘not charging for excess damage’

    Hi there

I have been looking to VT my car as my circumstances have changed and I will no longer be able to afford the monthly payments due to going on maternity leave soon.

I have contact my finance company- Black horse and have read details of their VT process online.

I have some damage to the car which would not be include in the fair and tear policy, however on their website it currently states ‘ We are not currently charging for excess mileage or damages so you won’t be charged, however this may change in the future.’

I have spoken to them over the phone and they have confirmed this, However I am still cautious that this wont be true once they collect the car.

They have sent me their VT letter that requires me to sign and they have said I have to complete and sign if I want to VT the car. The letter asks me to agree to the following: ‘ I understand I may need to make another payment depending on the condition of the vehicle.’

This is completely contradicts what they said on the phone and their website.

VT’ing the car is the best option for me currently but I don’t want to send it back and have excess charges for damages that I could have fixed myself prior to sending it back.

What should I do in this case? How can I guarantee that they will not charge for excess damage? Should I not sign their VT letter?

    Thank you

    Hi ED2468

    Welcome to LB

Take a screenshot of their website where it says they won't charge for 'damages.

Send a SAR to Black Horse, they have 30 days to provide all the data on the account. By doing this, your call will be logged stating that you asked about 'damages' and were told that they would not apply to you. You will have written evidence of the call.

    https://legalbeagles.info/library/gu...ccess-request/

You could cross the line out, add something like 'Reference Black Horse website and phone call 'damage not chargeable'.

Take pictures and video of car (not just the damage bits).

Say Black Horse go back on what you've been told and read on their website, then you would lodge a formal complaint with them, follow the complaints procedure on their website, once you get a final response / deadlock letter, if your still not happy, you lodge a complaint with the FOS.

      Hello,

I am currently in the same situation with Black Horse - the Turbo seized on my 2019 Seat Arona. The car is on HP with half the payments paid with 19mnths remaining. Due to the mileage on the car and that there other issues I called them up and explained I needed some help. They suggested VT would be a good option for me. They explained over the phone that excess mileage and damages would not be charged for. I explained there is some damage on the outside and the inside is below average. They advised I have to pay 108.88 for the 'liabilites' and 250 to have the auction company collect the vehicle which im fine with. It just seems a bit too good to be true given I have £4.100 left on the agreement.

I'm just wondering how you got on - did anything come back to bite you on the ass?

I have speken with them twice including asking them to confirm i writing or email that damages will not be charged for - but the operator said "thats not something we can do" but went on to reassure me, as the previous two operators did, that I wouldnt be charged anything over the £180.88 + £250 recovery charge. I recorded my last conversation with them but im still really nervous about it all

Any input would be greatly appreciated!

      Mike

Hey folks, what was the result on either of these ? Did you have to pay excess mileage / damage or not ?
