Hi,
I had a vehicle which was financed with BMWFS and did a VT. They charged me excess mileage which I refused to pay and heard no more.
I have recently realised that they have been putting a late payment on my credit file for FIVE YEARS!!
I have complained and they have refused to do anything despite me offering to pay the charge on a WOP basis. Are they legally allowed to record late payments for this long? Have complained to the FOS but I’m going round in circles and getting nowhere fast.
I’m going to instruct a solicitor but should I pay the charge to prevent further damage or will this weaken my position?
