My father has been going through a messy divorce, he married in 2016 and separated 4 years ago.
His wife lived with him in his house (inherited from his parents) she refused to move out and this has gone to court.
A court order in April stated that they both could occupy the house - one during the day and one during the night but no visitors or family were allowed access until the divorce was finalised. This was finalised in Sept and she was given 14 days to vacate the property which she did.
Another court case was booked for October which we had hoped would cancel the court order however he was taken ill and admitted to hospital and didn't attend the court case. In his absence she was able to get the court order extended until the financial remedy proceedings were completed which is booked for January.
My father passed away last week and my brother and I are joint executors. His will leaves everything jointly to us both.
How do we get access to the house - I am assuming that the court order is still valid but we will need to start probate proceedings soon.
Can anyone advise on our next steps please
