  • Income + Pension

    Hi,

I currently pay maintenance for my daughter via a mutual agreement a figure we obtained using the Child Maintenance Service online calculator and providing most recent pay statements as evidence of my income. I am about to leave the armed forces to start a new career but will also be in receipt of my armed forces pension. Prior to divorce being settled we had a minute of agreement in place and my ex wife agreed to forego my pension as she took the equity in the house.
My question is, when calculating child maintenance being paid do I need to use my taxable pension income in the figures even though she has given up any claim to it?
