  • 'Self Employment' Situation

    I worked a Zero Hours contract for a company - No issues, benefitted both sides.

    On 2nd April this year we received an e-mail notifying us they were switching us to a 'self-employed' role going forward - No issues.

    However I did not receive a Payslip for March, when I asked about it I was told in no uncertain terms I had agreed to be self-employed from March onwards and that they told me verbally before issuing in their words the 'formal notice' in April

    I have no idea what to do going forwards as they are stonewalling me at every turn. When I first asked about receiving a P45 I was told that I didn't need one and a UTR would suffice. Since asking again, both verbally and in writing they simply ignore the request.

    I have received my P60 for last Tax year calculated on earnings up until Feb.

    I phoned HMRC who told me to phone ACAS, in turn they told me to phone HMRC.

    Any advice on what to do next?

    How long have you worked there?

    Did anything change in the nature of the work you do that justified a change in status from employee to self employed? Self employment isn't simply a matter of choice that employer or employee can adopt at will. The nature of the work needs to meet the legal criteria for self employment.

      Over 10yrs. They will say I am not an employee, but a Casual Worker.

      Nothing has changed in the nature of the work, it seems to be a way to simply get around the NI hike.

      The new T&C's we were sent make it a tightrope between self employed and not, for example; we can subcontract in special circumstances and only if they agree in advance, it must be to someone already working for them. They will also pay that person.
