    I have less than two years service

    Can an employer put you through a disciplinary again for the same issue, despite no new evidence, or change in material? Having gone through a probation review meeting as the employer said you can’t be on probation and have a sanction on file? Their rational was to ensure fairness and consistency. ACAS is clear that fairness is individual and not comparative. Consistency should be achieved by correcting future handling not retrospectively punishing individuals. Original allegations October 2024 got suspended, back to work January 2025 after a probation review, case reopened June 2025, disciplinary July 2025 (I didn’t get an outcome because the disciplinary manager wanted to dismiss me, despite already being told I was not getting dismissed from a very senior leader in the company, I got suspended again in November 2025 (note inconsistency not getting suspended in June 2025). I have since put a grievance in for breach of mutual trust and confidence, procedural unfairness, and delay and suspension, I’m waiting for this to be heard.

    Your problem is that with less than 2 years' service you have not qualified for the right not to be unfairly dismissed.
