Hi there - myself and colleagues have been TUPE'd from one charity to another (we lost contract to another provider). We are moving with existing terms and salary intact (24.5K). However, not all of us are transferring which has left the new employer short of numbers. Therefore, they have advertised for new staff (doing exactly the same role as us) but bringing them in on their existing pay structure of 27.5K. New employer is refusing to harmonise pay for TUPE staff. Is this a fight worth picking? Thank you.

You transferred under TUPE on your existing terms and conditions your employer is not under an obligation to raise your salaries to the pay structure they operate. Pay differences can exist,
