    Good evening all.

    I am after some advice on if the Union are allowed representative, who was supposed to be representing me. I was called into the office for my return to work, after a second period of absence due to work based stress. I noticed on the screen there was a couple of discrepancies. The one I pointed out to management, the other I kept to myself. The meeting was postponed until there was a representative from the Union present.

    My return to work commenced with the union present. I explained my concerns to my Union rep, we were in the rest area. My Union rep said he needed to get advice from his senior's. Ten minutes later he returned, stating that they would be taking the start date from the absence dated 14/06/24 and placing it with the start date of the absence dated 07/02/25. In doing so, they have started a comedy of errors on my company's computerised records.

    My company has a policy in place:

    Employee handbook P.128 – Falsification of records
    "Attendance records are provided to maintain a record between the individual and the Company. It will be regarded as an act of gross misconduct for any employee to interfere with their Attendance Record or that of any other employee, for whatever reason."

    I believe the unions actions to be in breach of this policy. As I correct?

    Details:

    I was off work due to being bullied at work. Please note, my company do not recognise any bullying taking place. despite records being falsified and five statements being made against me for breaching my company's dignity at work policy. I believe this was to sabotage a personal injury claim and a grievance which I was raised against my former group leader.

    My fit note was 'Work based stress', the dates were:

    Someone from my former Bodyshop which I was bullied out of booked two days holiday for the 11th and 12th of December. This caused there to be a discrepancy with my company's Attendance Management Procedure.

    Someone had booked two Flexi Holidays for the 11th and 12 of December



    The entry for the 14/06/24 had no stage entered the cell ‘Stage issued’. The entry This made it appear I was on am Employment review.



    Therefore, my company's system had my stage one issued on the 02/01/24. JLRs System could be interpreted:

    Proof that when my ‘Return to Work ‘was initially held on the 04th March 2025, there was no ‘stage issued’ for the absence dated 14th June 24 can be found within Section 7 and section 9 of the Return-to-Work document:

    Section 07 - Management Attendance
    AMP Current Stage - Stage 01 - 19/01/24

    Section 09 - Current AMP Stage Details
    AMP Current Stage - Stage 01 - 19/01/24.

    The absence dated the 19/01/24 was for covid and was void from the AMP due to my appeal was not heard within the 91 day timeframe.

    It’s my belief that a manager entered the stage one’s date (19/01/2024), which was on the system on the 04th March 2024, when my RTW commenced. The RTW was postponed whilst waiting for Union representation.
    I have asked JLR, who inserted ‘Stage 1’ for the date, 14th June 2024? This was entered sometime between my RTW and the commencement of my RTW with Union. I had only raised this with PL L, and I contacted PAM Mr. CG to allow full disclosure to PL L. PAM G was the manager who conducted my appeal for the absence dated: 14/06/24.
    1. RTW commenced with Union representation:
    My Union Rep, Mr. T. C, had to seek advice from Senior steward, who stated that the discrepancies with the dates did not matter, the fact that the system had the correct start and end date was all that mattered, and a Stage two was issued. The union took the start date from entry ‘3’ and placed wit with the end date of entry ‘4’ to create an absence and my stage 2.
    I believe all the above breaches JLR’s policy, which can be seen on page 128 of the employee handbook, the section is entitled ‘Falsification of Records’.

    There return to work is dated 07/02/25. However, I did not return to work until the 10/20/25. Therefore, making it impossible for my return to work to be held on the date the company stated it was.
    1. Appeal of My RTW -
    On the 07th March 2025, I appealed against the Stage two, which was heard with my PAM, Mr. CH on the 01st April 2025. I was accompanied by my Union representative, Mr. T. C. My appeal was lost due to Mr. H spoke to the managers in BS2, it was stated, “there was no wrongdoing” and “We have washed our hands of him”. This was all verbal, nothing in writing. Union stated that management did not need to give me a formal response.
    Please see attached document for my appeal. There was no mention of the errors with my company's System.
    I lost my appeal.

    Page 2. Section 2 – absence details

    The start date is correct however as we have established my company's system had to flexi holidays booked, creating a separate absence, as seen in ‘a’. I returned to work on the 10th of February, not the 7th.

    Page 3 – Section 07 Managing attendance

    This states that I was on a stage one, the date of which is the 19th of January 2024. This absence was voided due to my appeal was not heard within time.

    Page 4 – Section 09 – Current absence stage details

    This section also is incorrect as it states that I was previously on a stage one, dated 19th January 2024. We have already established that this stage was void.
    Page 5 Section 10 Meeting outcome
    It appears that I have jumped from a stage one (void) to a stage two (second occasion).

    Unfortunately, my Partner contacted Norovirus from her place of work, she then passed it on to me. This caused me to be off again and triggered a ‘Final Counselling’.
    Due to the Unions advice, which management followed. The Return to Word Documents have a lot of anomalies. This included the Final Counselling document:
    04/03/25 – Section seven - Current stage - Final Counselling.
    24/03/25 – Section nine - Current stage – Final Counselling.
    24/03/25 – Section ten - new stage - Final Counselling

    Please can you set out what your specific questions are for this forum in relation to an apparent issue you have regarding absence record falsification relating to 2024 and earlier this year as this is not very clear from your post.

    You are also referring to documents that are not available for us to review.
