  • Employer Recorded Threatening to Lie at Tribunal

    Hi there, simple question.

    I'm in the process of going through ACAS early conciliation. I've been directly discriminated against by the head of the company, where they said they thought they used my Autism as an "excuse".

    I secretly recorded a conversation with him in which he said (and I quote):

    "Well, what if I just said I didn't say that? What if you just misheard me? My word against yours, pal"

    Me: "that's twisted. That would be a lie. What if I had proof you did say it?"

    "The only way you'd have proof is if it was recorded..."

    So, pretty clearly a slam dunk here. An admission by the head of the company that he is ready to commit perjury at the employment tribunal.

    Simple question: what will this do for my prospects of success in practice, what will the judge think, and what will it do for their credibility?
