    Disability Discrimination Act

    I have recently been diagnosed with a condition that means that I am covered by the Disability Discrimination Act. I have been signed off work since January and my employer is suggesting that I am unfit to return to work and willingly give me one month of adjusted duties to ease me back into the workplace. The Disability, which is mental health related, has been precipitated by poor treatment in the workplace. Should I try to return to work full time or should I accept that due to the treatment I have received at work I have now become too ill to work and accept that situation. Something here feels wrong? What is my legal position please?

    Hi helengalster , as you say your disability is created to mental health and you are not fit to do your full-time work. In my point of view, you need to take rest and had some medical treatments at home so you can get well son and if your employer does not allow you to take medical leave you can consult a disability discrimination lawyer so you can get the best legal advice.

    ULA many thanks and sorry for my slowness to reply. Yes, my employer has seen a report from from my psychiatrist confirming my condition and I have had a meeting with occupational health who have requested a report from him specifically about my suitability to return to work.

    dslippy Many thanks for your replies and apologies for being slow to respond. The adjustments would include phased return to normal full time duties including how many times I commute into the office rather than working remotely. The problem is that I don’t believe I can go from zero to full time full workload in the space of a month.

    Are the adjustments being suggested by your employer as a response to any medical report from your GP/Consultant or alternatively and Occupational Health appointment and subsequent report organised by your employer?

    Is the offer of adjusted duties a reasonable adjustment? To what extent have they tried to take into account your particular disabilities?

    Only you know how far a reasonable adjustment will fit with your condition.
