  • Line managers refusing to answer questions in writing .

    My employer has insinuated I asked & agreed to redeployment during a private conversation with him.

    This was not the case. My line manager brought up redeployment & I said I would consider it as an option.

    All correspondence after official meeting with HR & manager now state I asked for redeployment. I said I would consider it as an option only, I never actually agreed.

    my line manager & HR have now added me to the redeployment register. I have asked approximately 10 times via email in the last 8 weeks, what reason has been listed as redeployment, they refused to answer my question.

    after 5 weeks they finally answered “ breakdown in relationships within the office”

    I was very confused as to why this reason has been used. I asked why relationships have been broken & with whom.

    management & HR have refused to answer.

    they never seem to want to put anything in writing.

    is this allowed, am I within my right to have them respond in writing or can they choose not & reply via teams etc.

    i’d rather have it in writing for my records as, note taking in meeting haven’t been accurate. In fact no official note taker has been put in place, it’s been the manager.

    How long have you worked there?

    Are you a member of a union? If so, you could raise the matter with them.

    It might be an idea to see what it says in your employee handbook regarding 'redeployment' and the protocols involved.

    You've raised this informally with the communications you've had with management and HR, it might be time for you to raise a Formal Grievance in writing.

      Not sure how long ago he "private converation" with the manager happened, but have you at any time since emailed the manager and HR to clarify that yes redeployment was discussed however your response was that it was an option you would consider?

          No it doesn't apply. Your employer can't 'discriminate' against you. Discrimination means you’ve been treated less favourably because of a protected characteristic, such as race, gender, religion etc

            Ok thank you so, to be clear, if a persons employment ends & they have been employed by the company for less than two years (19 months) & they feel they have been let go due to sex, they in fact can take their employer to a tribunal?

                  Hi,

                  sorry for delay in responding. Yes I have several times, I’ve told them I didn’t initiate redeployment like they are stating.

                  they haven’t acknowledged any of my concerns in my grievance that I had raised. They thought redeployment was the best option. However I feel like I have been hardly tested compared to the other male.

                  he was very narcissistic in the relationship, it was borderline abuse but he has been allowed to remain whilst I’m being bullied into redeployment.

                        So to establish the facts:

                        1. You have been dismissed?
                        2. You have been employed for less than 2 years?
                        3. You believe that you were dimissed due to sex disrimination?

                        Now i need to ask the following questions:

                        1. What was the reason given by the company for the dismissal?
                        2. Did they go through any form of disciplinary procedure?
                        3. If so did you appeal the decision?
                        4. What are the grounds you believe you have for bringing an unfair dismissal claim due to sex discrimination?
                        5. What date was your employment terminated.
                        6. Did you raise any grievance with your employer over the redeloyment issue you first posted about?
                        7. If so what was the outcome and did you appeal this outcome?

                        Confirmation I have the facts correct and answers to the questions would be helpful in providing a response to you.
