    I am currently suspended from work but HR can't tell me if it is gross misconduct or a serious allegation until the investigation is complete - is this right? I would have expected they would be need to know this to be able to suspend me for it.
    HR didn't know the answer and couldn't explain anything, i have been told I just have to wait until the investigation is complete. Is there anything I can do?

    Once you have been suspended, your employer should confirm the suspension in writing shortly after. Any written notice confirming suspension should include the following information:
    • the reason for the suspension and how long it is expected to last,
    • acknowledgment that the suspension is not an assumption of guilt and is to enable the investigation to progress,
    • your rights and obligations during the suspension. For example, you may be required to remain contactable during normal work hours,
    • a point of contact (such as an HR manager) for any queries whilst suspended.

    If you have received this written document and the reason they state is gross misconduct or a serious allegation, as they are similar grounds, the employer may be using the investigative process to explore both. They should not, however, wait until the process is complete to tell you which they are fully investigating. Once the investigation has allowed them to understand the facts, they should tell you clearly which ground applies to your case.
