My Daughter has type 1 diabetes and her school is taking the classes out for swimming lessons. I consulted with her diabetes team at the hospital and they said they would want my daughter to take part and they encourage such activities, so no real concern there apart from ensuring she is monitored regularly.
The school have done a risk assessment and have come back to us saying we can take your child swimming, however a parent needs to accommodate her. Unfortunately we are busy and cannot be with her on the swimming lessons daily, we could probably do a few but not every day for the next 2 weeks.
We had a meeting regarding this with the Head Teacher, we mentioned our child will feel excluded and they should have staff who are able to accommodate her, which they said this is a high risk activity and without a parent being present it won't happen. We discussed this for nearly 30 mins but we ended up going round in circles. I ended up having to leave with disappointment from the school and any further agreement.
What are my legal rights here or how can I take this further? I always thought the school should accommodate her. I also don't agree with the high risk assessment they have done as they never consulted us or the hospital.
