    Hi

    just wondered what happens now as I believe the 28 days are up for the solicitor to respond to my defence, but iv not heard anything from them or the court as of yet.

    I filed my defence on the 21/03 & got a letter from the court the next day stating they recieved it and passed to the solicitor.

    Thank you x

      Per post #44, if they choose to proceed with the claim you will receive a directions Questionnaire from the court.
      & probably a completed one from the other party.
      The other party may well also contact you to negotiate a deal.

        Hey

        iv still not had anything back back since I put my defence in & they told me it was put to Lowell solicitors which was nearly 2 months ago, should I of heard from the court or solicitors to know what the next step is?

          If it were me I'd phone Northampton CCBC to find out the current status of the claim.
          If you have used MCOL, you could also check on there.

            Yes Iv done it all online but there’s nothing on their other than the actions Iv took, so confusing il give the court a call tomorrow thank you x

              Finally received the questionnaire today so all still going ahead!

              If if I offer to settle how much can I offer 25% 50% or I got to offer a lot more?

              If i offer to settle do I still fill in this questionnaire?

              Bit confused thank you for any help x

                  Anyone here to help??

                  Iv had an email regarding mediation to arrange a call to try get this settled, will they let me negotiate the price as I’m not happy to pay the full amount Lowell is requesting asi don’t believe it was even that much, were do I stand now. Thank u for any advice feel a lil nervous to talk to them x

                    Don't worry in mediation you don't talk directly to the claimant just to the mediator, they just pass messages between you.

                    Have They sent you any of the documents you asked for?

                    1: Agreement / Contract
                    2. Default Notice
                    3. Notice of Assignment
                    4. Full Breakdown of the Sum being claimed.

                    And have they told you the date of termination or default of the account? Think EE gave you an idea of when the account ended but no default / Termination notice.

                    Have a read back through your defence and note down anything they haven't provided you with and any queries it raises so you can raise them with the mediator.

                    You can use mediation in to negotiate an instalment plan if you wish, but I'd raise the missing documentation issues first and then they're more likely to accept a discounted offer.Mediation is under a without prejudice basis so don't worry about talking anything that you don't want bringing up in court
