  • Third party small claims

    I have a question about a small claims. I have submitted a claim against an insurance company- I am the third party. The defendant in this case the insurance company admitted guilt but 18 months on has only part paid. I have submitted and their lawyer has put in their defence. I have a question on the defendant as they have highlighted in their defence I have the wrong defendant but they have put in their defence and not asked for this to be struck out. Is this something I should change or will they likely strike out down the line.

    Sorry I should add it was suggested I claim against the underwriters. Is that normal.

      The article does state in the last paragraph that the innocent party may take legal action against the other party's insurance company

        I have spoken to the insurance company. They admitted liability and have made part payment but have gone quiet on the rest of the claim and I have raised a small claims.
