  • Defendant misleading court re witness statement

    Have a fast track claim against a local business. The owner is not British but has lived here (married to an Englishman she now says she is divorcing) for over 10 years and runs a business and a Post Office and posts online extensively in English. They have just sent us a costs schedule billing us for time off work to prepare her defence documents, write emails to us and even the time spent taking part in the court mediation. Not only are we being billed for her lost wages but also the cost of hiring someone to fill in for her and the cost of renting a friends room and equipment to prepare her defence and email us and paying for that same friend's time to help her with the wording and language as English is not her first language. £1400 in a fast track claim we have submitted for £4000 and offered to settle for half that amount during the mediation. Same person has asked a local government official to appear as a defence witness but they have said they do not get involved in civil cases and sent her an advice letter instead which has had the claim number and paragraph numbers hand written on it and sent to us with the rest of her witness statements. None of the defence documents have been filed wtih the court by the defendant, she has only sent them to us. Appreciate any comments re the costs schedule, the false witness statement etc Thanks.

    If you think that a witness statement contains things that are untrue, you should aim to demonstrate the inaccuracies.

    Does the letter/statement end with a "statement of truth"?

    Can you confirm that the claim has been allocated to the Fast Track and not the Small Claims Track.

      I thought court mediation was only provided on the small claims track
