  • Appeal to High Court

    Hi everyone,

    I am preparing an appeal to High Court on the matter of the strike-out of my claim in County Court, and I have some procedural questions that I cannot find a clear answer to.

    1. If I want to make an application together with my appeal, do I need to do it on N244 form and pay for that separately?
    2. Do I need to file a a skeleton agrument together with the appeal? In the CPR and guidance, it does not really say that it is mandatory, only "if requested", but I am afraid to do anything wrong.
    Should I file it anyway?

    You want to Appeal, but did you get Leave to Appeal from the Judge?

    Also, you should stick to the existing thread.

      There is a table in Practice Direction 52A which specifies the correct "destination" for appeals - https://www.justice.gov.uk/courts/pr.../pd_part52#III Are you sure that your appeal should not be made to a county court judge?

        Thanks for your answer, yes, I have a permission to appeal to High Court, it is explicitly stated in the Order that I am appealing.

        Sorry for starting a new thread.

          You need to read CPR Part 52 and the associated Practice Directions very carefully.

          I would have to do the same in order to give more detailed advice than that.

            I did. in and out, but still no clue whether I should attach my application on a N244 form separate from grounds of Appeal.

            But even discussing it with you clrears my mind!
