Wrong Amazon company small claims

You are wanting to sue a company located outside of England and Wales, the jurisdiction of the court. There are special rules that govern service of court proceedings on defendants outside the jurisdiction of the court. Those rules are not simple or straightforward.

Start by asking Eversheds if they will accept service of a new claim on behalf of Amazon EU SARL. DO THAT IN WRITING. If they say that they will accept service, then you can cut out the service out of the jurisdiction problem, because Eversheds will accept service within the jurisdiction..

In which case you start a new claim and comply with CPR Part 6 rules 30 onwards and Practice Direction 6B in respect of service out of the jurisdiction (links below).

To avoid that hassle, you could ask Eversheds if they will accept service for the Luxembourg company, and if they agree, serve them.

I just wanted to understand what basis AMAZON is building its defence on in most of the cases, when the right company got sued by the customer (the EU SÁRL one)
