  • Fast track claim: Can a personal friend be a witness in a professional capacity?

    I am in dispute with a builder over £15,000 advance payments for work and products not supplied and have a fast track court hearing scheduled for April 26.

    I am receiving informal assistance in the valuation of incomplete work from a retired quantity surveyor who is also a personal friend.

    I have much photographic evidence and email and SMS records which I am now compiling for disclosure, but at the allocation hearing the Judge also advised me to get a professional report, he advised by another builder, (but specifically not an expert witness) to back up my claim of work incomplete, and unreasonably delayed.

    My friend would be willing to provide a witness statement as defined by the directions order for the trial and has even offered to appear in court with me if allowed

    My question is, is it a matter for the court that my witness is a personal friend? I am prepared to tell them but it’s not mentioned anywhere on the disclosure process.

    I have found that other builders are unwilling to do what the judge suggested , my only other option would be to commission a surveying firm and this may be more than I need.
