  • N39 Order to attend court

    Hi,
    I have a CCJ against a small building company (Ltd) who did substandard work. They have not paid the CCJ so we have filed the N316A form for an officer of the company to attend court for questioning. Just a query on the N39 form we have received back to serve on him - should this be addressed to the company or the individual director only?

    If the CCJ was against the Ltd company, the order to attend for questionning would be addressed to the company, as per the judgment order. The company then choses the officer to attend ( which in a small company's case is likely to just be the director ).

      Ah ok,... the 316A form asked to name the officer / position and address (which i put the home address for)... i'm worried if it doesn't mention the company he may be able to refuse / reject it... although the court have filled this in.
