Well done, once the court passes the defence to the claimant they are allowed 28 days to respond, if they don't respond the court will stay (suspend) the claim, you are not told when this happens so keep an eye on the days as you will need to check with the court to find out what is happening.

The letter came from the courts dated 11th march to say that the claimant has 28 days, so that takes it to 13th april

If nothing happens and it is stayed then what happens next please?

Hi, if the claimant responds that they intend to continue you will be notified and you will receive directions from the court, however if they don't respond the court will stay the claim after 28 days, you are not informed if this happens so you will need to check with the court to see what has happened.

Leave a few days after the 28 expires as there's a backlog in the system.

I have just had a though. I submitted the defence but did not upload all my supporting documents, all previous correspondence : CCA request etc.
Shall I Upload everything to the Court Case or just wait to see if it is stayed in April?

Oh and an update, I have received no further correspondence and no copies of any documents as requested.

" Evidence and supporting documents will be disclosed at least 14 days prior to a hearing."

If you haven't received the agreement and the claimant doesn't respond to your defence the claim will be stayed.

Yes Charity, 28 days + 5 for service from the date the claimant receives the defence it's a normal part of the court process.

The paperwork has arrived and their is a covering letter stating that this is being allocated to a small claims track and there is a questionnaire attached that I need to complete for mediation.

Section D seems to be complex, do I have expert evidence and witnesses? I don't think I do. They are stating I will need to attend the court in Northampton, however this is hundreds of miles away, can I change to my local county court?

No witnesses. Tick yes for mediation ( It's expected that the parties to a claim will attempt resolution without recourse to trial)

If the claim goes to trial it will be at your nearest County Court Hearing Centre.

We have filed the DQ and this was logged on 29th April- nothing has happened since.

Are we to expect a phone call from Mediation? We have not received any of the documentation requested so is this all my hubby will have to say to the Mediator?

The small claims mediation service will be in touch, an will reiterate the " 4 questions " that need to answered " yes" to allow mediation to take place.
If all for cannot be positively answered usually the mediator declines to go forward and returns the claim to your nearest County Court Hearing Centre for directions.

After a period of silence a General Form of Judgment or Order has been received explaining that a hearing will be on 10 October. Documents have to be submitted to me by the claimant by 1st August.

Is there anything I need to do or prepare for this?

Hello Ij,

No order for you to don anything?

If not you cannot do much more than get your paperwork in order and wait and see what if anything the claimant has.

Is there detail as to what the claimant must disclose.
