    Hiya xx Yip same as Nikki - just fill in and return the DQ The DQ simply tells the court where and when the case should be dealt with xxx

      Hi Amethyst,

      Thank you for your quick reply, yes i have got better things to be worrying about at the moment, but this obviously is important and i would hate to do anything wrong at this point, i wasn't sure if i was supposed to agree to mediation, i felt it was almost like an admittance if i was prepared to discuss it further, if that makes sense!?

      I will send the form off tomorrow 1st class and send it recorded........how would i attach copies of the letters they have sent to me, including the £1 letter saying it was a for an o2 contract that had a £0 balance!?

        Thank you so much for responding. I was getting very concerned as I have just read about the N244 form that I should have requested before handing in my defence and now that is obviously too late as my defence was submitted on the 12th of February. So just to clarify I should fill out the questionnaire requesting mediation and then say at mediation that I have not received any requested documents. I also had my £1 postal order returned, should I mention this?

            No need to mention the £1 in the DQ form - that will come later after your case has been sent over to your local court and you are asked to submit witness statements xxxx

                Not sure what I should do next, had a phone call out of the blue yesterday from the mediation service, they emailed me late on Friday asking if I could answer 4 questions which would decide whether the claim was suitable for mediation, I didn't see the email until Monday night, I explained I hadn't had the requested documents and therefore from the 4 questions they asked it meant it wasn't suitable for mediation, I explained this to the person who called me, he said I should agree to mediation and although they can't advise me what to do I the need to ask for a hearing,,....can't believe I I'll have to take time off work and go to court, surely they haven't provided the documents it should be thrown out by the court!?

                i have agreed to call them back to agree to the mediation appointment today, but still not sure if I should say I don't want to have mediation, can you help please, many thanks

                  Not sure what I should do next, the mediation service called asking if I could answer the 4 questions which would decide whether the claim was suitable for mediation, I explained I hadn't had the requested documents and therefore from the 4 questions they asked i guessed it wasn't suitable for mediation, he said I should agree to mediation and although they can't advise me what to do, he then said I need to ask for a hearing!!?

                  I don't know if i should be chasing BW Legal for the documents i have requested again or do i just wait to hear back from the court, they know i have already pointed out the debt they are chasing is statute barred so I still can't believe I I'll have to take time off work and go to court, will the court stop this continuing as surely as they haven't provided the documents it should be thrown out by the court!?

                  Any help or advice please would be gratefully appreciated.

                          The Mediator will pass the claim to your local county court hearing centre and you don't have the supporting documents to allow mediation to go forward, you will receive further directions from your local court.
