                  yes I do have them shall i scan that as well one things is i have 2 copies don't know when I got these but
                  one is good quality paper no signature from me just a faint pj lyman and my name written in by someone else.
                  I have done the CPR after 2 emails one they wanted some confirmation which seemed ok to me.
                  just also sent an email mcol to make sure it was extended to 28 days as i haven't had anything to say it had been done. Also what kind of documents should I provide are they my hardship ones or is there anything else I should scan. thanks again for checking my thread and helping

                      Looks to me like an attempt to make up a "reconstituted" agreement.
                      This must have:

                      Your name and address as it was when the agreement was signed: ( Can't see that on the document here)
                      The creditors name and address as it was when the account was opened.
                      All the relevant T's & C's at the opening and closing of the account.
                      Any other documents mentioned in the T's & C's.
                      Any material amendments made during the life of the agreement.

                          The ones you posted today do seem to be a photocopy of the reverse of the page you posted up last week, looks like it was in two parts so you'd sign and return one and keep the other as your copy. I can't see any date on the first agreement, when did you open this account?

                          Also did you initially go to the website to order goods and were later sent that agreement to sign? Or how did you apply for the account? Over the phone? A mailout? A little history can go a long way.

                          So did BW Legal agree to a 28 day extension and you informed the court? Because they have to agree to the 28 day extension before you tell the court about it.

                          And just to be clear, the agreement you've posted was sent in response to your CCA request, not your CPR request, to which BW Legal haven't replied, and that's the reason the extension was agreed?

                          You don't need to provide documents at this stage, and hardship is not a defence to a claim as such, although it could be used at a later stage if the claim cannot be successfully defended, to negotiate a low monthly repayment or F&F settlement.

                          What you have posted is a letter offering you a 20% discount off future orders, that's hardly against the law. As with any business, they'd want you to buy more from them and would be prepared to give you more credit for that purpose, nothing unusual about that. It's not uncommon for banks and finance companies to offer consolidation loans to pay off your other debts by getting into yet more debt. Very often that's not the best solution, and I should know, having once been offered one of them by the A&L with minimal fuss, however, it's not unlawful for companies to try to get you into more debt, it' left up to the individual to decide whether to accept the offer or not. :decision:

                              Those 'on hold' statements are highly misleading. :mmph: CPR 15.5 allows a maximum of 28 days to be agreed on top of the original deadline to file your defence, it doesn't allow for an indefinite extension or one that starts to run from when they feel like contacting you, if you see what I mean. :ohwell: If you have already informed the court that a 28 day extension has been agreed, I'd stick to that as a deadline to file your defence, i.e. 28 days are added to your original 33 days from date printed on the claim, if that makes sense to you. :tinysmile_twink_t2:

                                got reply from bw legal they are getting back to lowell and possibly to get the cpr which more than likely be what i have alrready the dodgey agreement and what my wife purchased
