Entering the defence - Debt is almost 6 years since default..

      It should have been done within 14 days of the date on the claim form.

      It's probably late by a few days. Update the thread when you get an
      update.

        Had a letter from the court letting me know they've ackowledged receipt of my defence, the claiment has 28 days to contact the court if they want to proceed.

        Kearnes also wrote to me letting me know they were still waiting for L C Asset to provide the information requested.

        I gave L C Asset 12 working days to provide the copy of the agreement, it's now been around 17 days and they haven't provided it, should I do anything else or just wait the 28 days?

          I'd make a note of that. I'd wait to see what, if anything they send.

            I've finally had a reply, They have sent me copy of bank statements from June 2019 through to December 2019, it shows my last payment to them was June 2019, a copy of the Notice of the assignments and a copy of the statement of the account. there is no agreement or default notice, unless it's called something different? any advice? Thanks

              O.K. So the debt isn't statute barred, they filed the claim in May 2025.

              You need to check what they have sent i.e. Notice of Assignment, make sure it's compliant.
              The Statement of Account has all the correct info / it adds up from the facts you know.

              There are still documents outstanding i.e. The Agreement and Default Notice.

                Thanks for the reply, Everything so far looks ok as far as I can remember, the assignment is corrrect, I don't have the agreement or the default notice, what should I do now? write to them again asking for the agreement and default notice?

                  You've sent your requests, they've got the requests, it's down to them to comply.
                  It's not down to you to chase them. You've done what needs to be done.

                      MCOL will have basic details, i.e. Claim, Defence, other then that it can't be relied on.
