Kearns solicitor/l.c asset/ link outsourcing

    Just posting an update. After filing my defence, the Court sent me a letter advising Kearns had 28 days to respond after receiving my defence. I received this on 28 May and have heard nothing from Kearns as of today. Link financial sent a statement of accounts on behalf of L.C Asset. Which is dated from 10 December 2024 and shows the original balance plus court fees and interest charges of 8%. This was sent on 9 June and received around 20 June. I'm unsure currently whether Kearns have advised the Court they wish to proceed.

    The case is stayed until they do.

    If they wish to proceed and lift the stay, they would have to pay a fee, file the forms etc.

    So really nothing for you to do. Update the thread when you get anything though.

        Hello, I have today received a large pack of paperwork from Link Financial on behalf of L.C Asset. Which also includes a full SAR. I've gone through the pack and have found a letter dated 19 May 2025 from Barclaycard. Ironically it is a copy in the pack I never received this through my door. The letter states:

        'We refer to your request for documentation u der which we must provide a copy of the executed agreement (and any document referred to in it) and a statement of the account. We need to advise you that, regrettably, we are currently unable to fulfill your request. As such, we are not currently able to enforce our agreement with you and the agreement will remain unenforceable until such time as we are able to fulfill your request.

        Whilst discussions continue, we know that we're not able to enforce our agreement with you. But our rights continue to exist under the agreement. You must continue to pay your outstanding balance.

        It is important to note where debt has accrued on your account, we will, where required, report to credit refermece agencies, demand payment from you, issue a default notice and instruct a third party to demand payment or otherwise seek payment from you.

        This completes our obligations under section 78 of the act''.

        What do I do now?

          So you've received the SAR request.

          Have you received the requested documents, CCA and CPR requests?

          As it stands the case is 'stayed', but it's a good idea to check with the Court, give them a call.

            Just updating as it has taken some time to receive a reply from the Court. They've confirmed the case is now stayed.

            I believe I received CCA but not CPR as they were unable to provide it.

                I think you might mean 'Default Notice' and 'Letter of Assignment'.

                The CPR refers to Civil Procedure Rules, you sent a CPR31.14 request so they've sent a CCA, but not the 'Default Notice' and 'Letter of Assignment'.
