  • Court claim

    I recieved a court claim about two months ago
    requested information from the client and solicitor re consumer credit act and data protection as advised on here
    Made my defence with the court
    Heard nothing back from the creditor or solicitor until this morning when I recieved a letter from TM legal saying there have all information to send to the court and my defence has no merit
    However there have offered a reduced rate of the debt how can there have information but failed to send me any
    What are my next steps of action please

    Did your Defence document follow the "Example Defence" under "SHORTCUTS" on this forum?

    Hopefully you included the equivalent of paragraphs 16 and 17, and under 17 if the requested documents are received by the defendant, the defendant will be in a position to amend his defence.

    You need to obtain these documents from TM legal so you can check their validity and amend your defence.

    The court should order the claimant to pay the cost of amending your defence, including any application notice fee. Paragraph 17 in the example defence covers this

      If this thread relates to your thread started on 11 April which is about a mobile phone contract, then CCA 74 does not apply, and the company does not have to provide the customer with a default notice

        No it's nothing to do with the phone contract it's about a catalogue
        yes I used the defence from this forum
        I've requested information from TM legal before I filed my defence and just got ignored until today
        So I dunno what my next steps are now

          Do I request the information again from TM Legal or do I just wait to hear back from the court

            When the claimant files evidence with the court, they should send a copy to the defendant
            IMO you should just email TM reminding them to serve you with any documents filed with the court
