Hi All,

I have a similar issue with this company called patking Eye
i recently received a small claim form from Northampton Court from which I responded within 14 days and later filed a defence within 28 days from the date of issue.

the time i filed the acknowledgement of service was early April and was not processed until late April, 2 days after a county court default judgement has been issued.

Now I received the attached General Directions of Order from the court the the judgement be set aside?

My question is:
1. As i have already requested CPR 31.14 which was not honoured by the company and have filed a defence based on the template provided, do I have to do anything at this stage?
2. What is the next stage here?

You can ignore them or
You can try negotiating with them, but do so on the basis that you are the keeper, not the driver, and you are only negotiating to avoid the costs of a court appearance.
Be sure to mark any approach as "without prejudice"

You can await the court to contact you, or you can download form Ni80 (https://www.gov.uk/government/public...l-claims-track) and send competed form to court and to solicitors.

I have received an email about a mediation appointment. i have put my own details in for the appointment but what would we discuss and what is the appropriate response?

Mediation which is carried out through a third party, the mediator who shuffles between you.
You probably won't get to discuss anything, just put your position across.
The standard of mediation seems to vary greatly

Mediation doesn't work unless both sides are prepared to compromise.
Now i anticipate you don't want to pay anything, but PE want to collect in full

If it goes to a court hearing PE have to pay their representative (possibly a newly qualified solicitor) so even if they win in court they won't necessarily make money so it is likely they are prepared to settle for less

Now you need to take into account ( if you win) your costs which you can't recover e.g time & effort and possibly a whole day in court just waiting. How do you value your time? You may get back some travelling expenses and a small amount for loss of earnings (c£95?)
If you lose your outgoings are much higher.
What level of compromise (if any) are you prepared to make?
