Court Claim Against Parents - Only two days to acknowledge Service

Hi,

I have just discovered that my parents have had a county court claim against them for un-paid services charges on a property they own.

The date of service was 1st May and I found out yesterday when I went to my dads house and opened his mail.

My father has stage 4 brain cancer, he's been through brain surgery and radiotherapy recently and about 4 months again my mother was admitted to a dementia care home.

They simply don't read emails and letters anymore and had no idea this was happening.

I'm happy to admit it and pay the money requested as they do owe it, but one thing I have noticed is that on the front of the claim form

Brief Details of claim
Outstanding arrerars of service charge in relation to --

And then instead of the property that they owe the services charges on, they have put my parents home address. Is this right?

I'm not trying to get out of it, I'm just trying to buy myself some more time.

Any thoughts would be greatly appreciated.

Can they pay the outstanding amounts? That would be one way of resolving this quickly. Do you hold power of attorney?

You could put in a defence denying that money is owed in respect of the named property, but that won't get rid of the case.

Is the amount claimed above or below the £10,000 'small claims' limit?

Sorry, I never replied to this. The court claim against my parents stated the wrong address. I informed the solicitors and told them I would pay the outstanding amount in full but I would not be paying their legal fees or courts costs due to their incompetence.

They agreed.
