    Hi my partner received a ccj claim with an issue date of 21/12/2018. He replied with the admission form and a letter offering a monthly payment and sent it in the post by recorded delivery. We have now received a letter back from them dated 11/1/19 received yesterday 16/1/19 saying they haven't received a response and that further action will be taken. How ever I've checked the tracking of the letter and it was signed for at 8.15am 11/1/19 so they've received the letter and then wrote to him to say they've had no response.

    Yesterday 16/1/19 they filed for a ccj as it showing on his credit file.

    Where does he stand with this considering he did answer and offered repayments yet they gone ahead anyway

    If he completed the admission form N9a and sent it to the Claimant then he will have a judgment against him although it seems very quick for it to show on his credit file already. The letter they sent on the 11th is likely to have crossed in the post with the admission.

    The admission would have been received late if he hadn't acknowledged the claim as that only has 14 days from service which would have been around 5th Jan so they could have filed for a default judgement anytime after that.

    Soooo, give the court a call and ask them the status of the claim - he will receive a judgment order through the post but might take a while. You want to know if an instalment order has been made from the admission form, or if the claimant asked for a default judgment.

    Also give MC a call and ask them what's happening as you haven't heard from them since sending in the admission form.

    Then you will at least know what the situation is and can, if needed, take any steps to rectify.

    Presumsbly the debt is quite recent and there were no disputes on it.
