      Sorry Coffee Guru, yes you can email it to the court but it would be better to submit it online on Moneyclaim online , you should have the log in details from when you filed your acknowledgment ( bottom right of the claim form?)

      Did BW actually send any documents when they wrote to you saying about obtaining default judgment on the 26th ?

        I have tried to log in to MCOL but the details they gave me on the form dont work.

        I will ring the court this arvo if i can get away from work. Just check that they arent about to give me a CCJ !

          Just make sure they have logged that you have sent your defence by email to them and put a barr on the case file so the other side can't get a default judgment. Did you acknowledge on paper or through MCOL originally ? It may be if you acknowledge on paper the online stuff isn't accessible anymore.

            Ok, Yeah I thought I would ring up the court just to settle it and they confirmed my defense has been received by them and sent to the claimant for response. Thanks for your help.

              Thank goodness for that ( you couldn't settle it with the court anyway it would have to be with the claimant ) ... let's see what they come back with and whether they want to continue after receiving your defence before looking again at settling xxxx

                Just an update...

                Couple of days after I submitted the defense the court sent me a printed copy out to my address along with a letter that confirmed no further action needed to be taken by myself for the time being...

                Around the 9th Nov received a letter from BW Legal saying they had asked the original creditor to send the appropriate documents. Also asked me to confirm my address as they had a different one on file - which was odd as the court papers and their letter came to the same address.

                I think this will hopefully be the end of it

                    Weird. Have you replied to Cabot to give them your correct address ( and point out it is the same as that on file ) Don't give them any previous addresses though.

                      I thought that would be the end of it tbh, And the fact they sent a letter to me and had the correct address on the court form I thought negated the need for me to confirm my address.

                      However, I have just had a letter from BW Legal informing me that their client has notified the court that they are going to proceed with the claim.

                      They haven't given me any of the documents I have requested. So, is the next thing going to be a court date?

                        Next should be a Directions Questionnaire - https://legalbeagles.info/library/gu...questionnaire/

                        You should receive an N180 form from the court to complete and file & serve. Just tells the court what to do with the case so that a Judge can issue any directions / set a hearing date.

                        Did you ever do a SAR to Orange/EE etc ? Might be worth doing.
