  • Lloyds and Cabot v Del

    Good evening,
I am back here again asking for help about a credit card from Lloyds bank which I opened in 2006. I last paid into this credit card in 2010. I claimed PPI on this credit card together with my loan which I had also from Lloyds and had compensation paid to me by Lloyds in November 2011. I had kept all correspondence from Lloyds over the years until I moved house at the end of 2017. This credit card debt was on my credit file until 2016. I thought this was gone away and I got rid of most off the letters Lloyds sent me over the years. I now have cabot financial chasing me for this debt which I thought was over and done with when they paid compensation in 2011 but no. I asked Lloyds about this and they said they sold the account in 2012. They wanted me to give them information about the compensation they paid including ref numbers which I did not have.
I said they should have all this information but they said they could not find it. Cabot financial is sending me a copy of contract which they say I signed in 2006. I cannot read anything out of it. They are telling me I last paid for this card in 2014 of which I know I did not. The statement of the £1 payment does not show where it was paid and I am not even aware of it. Cabot tells me the account is not statute bared, they own the account and I should pay for it. I tried asking them to not contact me about this but they are standing their ground and they have given me a few days to provide them with evidence of what I have said to them. I am fearing they will put this on my credit file again and I will have to suffer again for the next six years.
I am deeply disturbed and worried about this. I now don't know what my options are here. If anyone could advise, please do. I will really appreciate your help as you did before.

    Many thanks in advance.

    Hi Del
    How much is this for?

So have you sent them a CCA request with the fee?

If so what have they sent back to you- just the agreement

If you haven;t sent a CCA request with the fee then I would suggest that is your next step.

By the sounds of it this debt may well be SB- are you absolutely sure you have never paid them or sent a cca request to them. If the payment was for £1 the simplest explanation is that you did send a request and they allocated the fee to your account.

Thanks WARWICK for you quick response. This is for £2200. I have not sent any request for anything to Cabot. I don't even know what CCA is. I don't even know how much the fee is if want to request the CCA. I will have a look on here and see if I can find any information. I will post if I find some information on here as I am totally lost.

          Just quickly -
I am fearing they will put this on my credit file again and I will have to suffer again for the next six years.
As this has already been on your credit file, and defaulted apparently in 2010, it can't be put back on to your credit file unless they did go to court and obtain a CCJ against you.

The statement of the £1 payment does not show where it was paid
If there is a date for the £1 payment you could obtain a copy of your bank statement for that date to show you did not make the payment. First though I would be asking for more information including the method of payment ( ''so you can check your records '')

Thank you MIKE. I have now sent a CCA request letter.
I have this on one of their letter saying they bought the account from Lloyds in 2012 and reported this to the CRA and their entry dropped off on 20 January 2016 when the six year limitation expired. They are saying they can confirm the account is not statute bared. They sent a statement which they say I used to pay on the account by Giro from 2010 until 2014 which I do not recognize. I was under the impression they will send me a statement the credit card. Is it possible that they can register this account again for the second time with the CRA?

I don't think that is the case- are you getting mixed up with giro bank?

I seem to remember it could mean money going into an account via a bank or cheque

I will have a look at some old bank statements and see what they show

                    Yep-
Just looked at some bank statements from 2011 and payments going into my account said bank giro credit so I assume if I made payments into another account they would show the same

They payments did however say where they came from

There were 2 £1 cca payments made on this account (mentioned at the start of this thread) ... could one of them be the 'giro' payment??

Makes more sense than giro cheques - BGC - thanks Warwick.

Del - you'll need to check a couple statements from when they claim you paid.

Thank you AMETHYST. I am waiting for them to send me a statement from the credit card account so I can have a look. So far the print out they sent saying I was paying by Giro until 2014 is not the credit card statement. I know I never made any payments to any LIoyds account from 2011 when they paid me for PPI. I am waiting to see what statement they will send me.

The debt would have dropped off your CRA file six years after the default was registered regardless of whether you were paying them or not at the stage.

The CRA file removal is not related to Statute Barred issues.

You are not sent the regular monthly credit card statements once a debt has been defaulted, but have you been sent a annual Notice of Sums in Arrears since the default?

(My apologies for not reading back through your whole thread before posting.)

This is Lloyds and completely separate from the previous barclaycard posts I believe? - I think it might be an idea to split the thread so you keep the Lloyds and BC debts separate ( I was just having a read back about this payments from 2010-2014 and getting a little confused lol) - is that okay with you Del ?
