  • Court order - date of service

    Have been awaiting an order from County Court for several weeks. Decided to call the court for an update (took hours to get through to them). They told me the order had been issued, and they sent me a copy by email. This happened on 29 August. When I opened the order on the email, I saw it was dated 11th August. The order stated that I had 14 days to set aside from date of service - which, if the date on the order (11th) is the defining factor, has now passed. So I am wondering whether the hard copy of the letter went missing in the post, or is it still in the court postroom awaiting being placed in a postbox? Does anyone know if there is usually a delay between the date of the order being issued and the court post room eventually getting round to sticking it in a post box? I am also wondering whether I am out of time for setting aside - i,e, what is the deemed date of service here: the date on the order or the date it gets put in a post box?

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
