  • Consent Order confusion

    I have recently been made aware of a CCJ in my name from 2018. Acting promptly, I am sending a consent order to the claimants solicitors. I am NOT disputing the claim however I am wanting the CCJ set aside as I am applying for a mortgage.

    If writing that I will pay the claim sum in full within a 14 day period, would that be from the date of consent being signed by claimant or the court order being sealed?

    Please can someone clarify the process if/once consent is agreed on the terms that if paid in full, the judgement is set aside.

    In summary, I need to know when is best to agree to pay, and how I actually go about paying.

    If you have a copy of the CCJ it will tell you who to pay and even if you don’t have a copy you just pay the claimant the full amount by any means that allows you to prove payment like a cheque or credit / debit card.
    A county court judgement unless it was paid in full within 28 days of the judgement date, will stay on your credit record for six years. When paid it will be marked ‘satisfied’ but will still remain on your credit file.
