    Im after some help please I've recieved a claim form from the county court business centre Issue date 12 June I've only just recieved this as it went to my mother's address I never get mail there and if I do my mam generally throws it as its junk... luckily or not she checked this one

    The particulars say this

    This claim is for the sum of £2100 (approx) in respect of monies owing under an Agreement with the account no xxxx pursuant to the consumer credit act 1974 (cca).
    the debt was legally assigned by Hoist Portfolio holding Ltd (ex Barclaycard) to the claimant and notice has been served. The defendant has failed to make contractual payments under the terms of the agreement. A default notice has been served upon the defendant pursuant to a.87(1) CCA .
    The claimant claims
    1. The sum of £2100 (approx)
    2. Costs

    That's it
    I believe this to be from a Barclaycard I had around 2006 and in about 2010 I made an offer of settlement to this card and another I had....the other card company accepted the offer but Barclays didn't so since about 2010 I havn't paid or replied to any letters from anything to do with this debt until today. I unfortunately cant find any paperwork relating to this as ive moved a far frw times.I does not appear on my credit score fole (noddle) anymore like it used to.

    Any help at all is appreciated.

      Hi....I read some posts on here and managed to send off a letter to each (Hoist and Cohens) in the timeframe. I've recieved a reply and returned postal order from Cohens if anybody is available to help i can tell you what it says just need help on my next step thanks

          Good morning, apologies to have missed your previous post, it looks like everything is on track. Did you acknowledge the claim with intent to defend?

          The debt defaulted in 2011 but they have claimed you made a payment in 2014, do you recall making payments after the deck defaulted, I note in your first post that you didn't think you had. It might be worth replying to them and asking them for further details of any payments between 2011 and 2014 As you considered the agreement / debt to be statute barred.

            Thank you for reply.....I'm 90% certain that after I offered them a settlement and they declined in 2010 I never paid anything or got in touch. Is it a request letter to ust Cohens you're suggesting? Thanks

              Is it worth me sending another letter to cohens about this supposed payment I don't reckon I made?.... would they lie about that? or is it hoist telling them false things

                Hi.... I've recieved a Cohen Cramer pack last week
                , it has an original credit agreement from august 2007
                Then a copy of default dated 24-09-2010
                Then a copy of assignment dated 10-09-2018 this was sent to a different address to the one I've had correspondence with.
                What's my next step? anybody

                    I'm not able to help, but having loitered for a while I'd suggest maybe posting up some redacted copies of what you've had back so that when someone more useful pops by, you'll have given them some more info

                    Sorry I can't be more help! Am sure Amethyst will be along soon enough though!
