  • How do i sue Vodafone?

    Hi,

    I have had nothing but hell with Vodafone over the last 5yrs.

    Account 1: I took an iPhone out with CPW and the network was provided by Vodafone. I returned the phone as it was faulty and cancelled the contract. 1yr later , i checked my credit file as was going to go for a mortgage and had a default off Vodafone for this account. I called them and played hell with them and eventually after 3yrs , YES 3yrs , got it taken off.

    Account 2: I ordered a phone from a company and Vodafone was the network. 2 days after the order i was called by them and they advised me that they couldn't process the order as the stock was going to be very late (was the new iPhone at the time). So the order was cancelled and i bought it from o2 instead. A year or so later i checked my credit file again (my credit card provider said i couldn't get an increase due to poor credit) and lo and behold, a default off Vodafone. I called them last July, played hell and was eventually offered £100 compensation and to take the default off. I had asked for £500 as they had damaged my credit file and i couldn't get an increase on my credit card due to them. I spoke to various Vodafone staff, 99% of them totally incompetent, and was assured that the cheque had been sent. A month later i called and was told the cheque hadn't been sent. I told them that i wanted at least £150 and was put on hold for 30 mins whilst the advisor checked this. She came back and said "sorry we cant increase it as the cheque lady actually has your cheque in her hand". That was August last year. To this day i haven't received a cheque and have recently spoken to at least 10 Vodafone staff who are just fobbing me off.

    I really am at the end of my tether. I know i can go to the ombudsman but i don't trust that process to be honest as its almost as if Vodafone are steering me to that to get out of it.

    How would i sue them? Could i put a small claims court summons in for much more than the £100 as i have spent many hours and time trying to sort this out. My credit file is still stained as my credit card provider has said that i cant have an increase as i had a default within the last 12 months. I got Vodafone to send me a letter to explain that it was put on in error but still they refuse.
