			<content:encoded><![CDATA[Hi, looking to find out who the best lawyer / Law Firm in England for fighting the Insolvency Service for a Director defending against the Insolvency Service against them coming after him for a company being wound up (compulsory court wind up). Also they allege he was acting as a shadow director so also defence against director disqualification, and personal liability claims etc etc.<br />
There are so many law firms out there and its hard to tell which are the best for this (especially as most seem to be jack of all trades….), so am really looking for the best in England specifically for these matters who have the best success and specific expertise in this area. Money/cost is not a problem. Thanks so much in advance.<br />

Hoping to get advice on this situation please.<br />
We were informed by immediate neighbours that they would be getting scaffolding put up at the rear of their property for some minor repairs. We were assured access to our property was not required as someone had visited and determined all the work could be done their side. However when they came to put the scaffolding up they decided they would need to put &quot;a pole&quot; on my side. I had to rush home from work to see what was needed and at no point did I agree or consent to them doing any work on my side. When I arrived home they had removed a fence panel to access my back garden and moved everything from my patio to put up scaffolding poles etc. And I couldn't even open the rear door initially as it was blocked by their poles etc. There was some minor damage to a few items (not expensive, around a tenner or so to replace). The main issue at the time was there was an area in the garden of great sentimental value due to a very recent loss in the family. This area was trodden on we believe causing a lot of upset. There was only one person present at home at the time and they suffer from anxiety and agoraphobia and were sat in the living room watching TV when suddenly workmen appeared outside the back doors and resulted in her hiding in the bathroom in tears as she worried about there being harm done to the patch of great sentimental value in the garden, the shock of people entering the garden and general disturbance. She also suffers from OCD so having things moved around caused a great deal of stress as well.<br />
There was no notice or advice of this activity, they didn't even knock on the door or anything.<br />
The neighbours were very apologetic but only rent and the landlord arranged the work to be done. They have tried to make up for it and are nice neighbours so we don't want to take action that would impact them as such. They aren't happy about it either and complained to the landlord about it.<br />
<br />
We have heard ideas of charging to use our land and have the scaffolding on it and demand an insurance certificate. It is a well known company with good reputation. I believe the psychological elements might be very costly to act upon or claim on otherwise.<br />
<br />
What are your thoughts on this one?<br />

One flat was recently sold and rented out.<br />

In the 3 weeks since there have been multiple leach breases by the subtenants and their landlord. The landlord is in the process of buying the third flat, which will give him 2 shares and control of the freehold company, a casting vote on mgmt decisions etc.<br />
<br />
I own flat A, the new buyer owns/rents out Flat B and will soon own Flat C<br />
<br />
<br />
I asked a solicitor to review the companys articles of association when I learned he was buying a second flat. The solicitor identified some ambiguities and uncertainties regarding when he would have 2 votes or 1 vote, and proposed some amendments, but this requires all 3 current owners to agree. Both seller and buyer were initially open.<br />
<br />
However since:<br />
<br />
a) his subtenants left food bins on the communal landing, the bin was full of maggots when I removed it, 4 days later flies were visible on my floor and theirs, along with maggot shells embedded in the carpet. I informed all parties including mgmt agent. On day 3 of more flies emerging I text Flat B owner a quote for same day treatment. He wanted to attend in the evening to check his tenants caused it, and ask them to clean it if so. I thought this was absurd so arranged a professional treatment that cost £198.<br />
<br />
The lease states that cost of any repairs caused by an owners negligence must be reimbursed to the freeholder. Flat B is currently only offering to repay me 60-70%. He told the mgmt agent I agreed to that, I did not - and he spent most of the meeting after the pro treatment accusing me of suffocating his tenants children with RAID fly spray used in the communal areas. (he withdrew when I told him it was scientifically impossible)<br />
<br />
The seller of Flat C has avoided giving his opinion, presumably to avoid upsetting Flat B who is buying his flat. I reminded both, we have a legal and fidicuiary duty to the building and company, and to avoid conflicts of interest.<br />
<br />
The point of contention is speed at which I acted and not waiting for a consensus - however, day 3 of an ongoing infestation is not too fast - and as the person liable for negligence of his subtenants and resulting costs, Flat B has a clear conflict of interest.<br />
<br />
The cost remains un-reimbursed<br />
<br />
b) The lease states consent must be assigned to sublet, and a deed of covenant between tenants and freeholder signed so they agree to follow the lease. This has not been done.<br />
<br />
c) His subtenants put laundry on communal patio areas. Flat B then asked me to let them. I and mgmt agent said the lease is not optional<br />
<br />
d) he's made multiple false claims about the land - saying the communal patio areas belong to B and C.  Saying the first and second floors aren't my responsibility- so don't go up there for maintenance issues.<br />
<br />
<br />
<br />
So in a month of his ownership there has been multiple serious breaches of the lease, failure to accept liability for basic and obvious emergency maintenance issues, a relaxed attitude towards lease compliance and a clear conflict of interest between his roles as leaseholder, freeholder and landlord to his subtenants.<br />
<br />
Myself and Flat C were asked to approve him as a Director (request came immediately after the fly costs email from mgmt agent), I have not approved due to the costs issue.<br />
<br />
<br />
I am now wondering if I have genuine grounds to refuse consent to assign Flat C due to current active lease breaches, and past ones. And general character - false accusations of suffocating children, saying I had agreed his liability was only 60-70%<br />
<br />
It seems there is a loop - where his remedy for not getting consent to rent is to ask for consent, but if I refuse due to issues with his tenants, that prevents him from remedying the breach?]]></content:encoded>

My friend who was travelling with me got out of my car and made the rest of her journey on foot. I have today 25th July received a PCN dated and posted 21st July from Vehicle Control Services Limited PO Box  Sheffield S9 9DJ who are an IPC member with a PCN. Reason stated stopping to pick up/ drop off in a restricted zone. I know parking companies won’t go down without a fight but if anyone can give me any help on an appeal I would be really grateful </content:encoded>

In my honest opinion, the Local Government and Social Care Ombudsman (&quot;the Ombudsman&quot;) is not acting impartially. I have discovered that they are outsourcing their casework to the large law firm Bevan Brittan LLP (costing the taxpayer a fortune in the process). It is reasonable to believe that Bevan Brittan LLP, being paid public funds, considers the government as its client, and that includes local government. <br />
<br />
I have complained about this issue, and the response that I got back was very ambiguous, and deliberately so in my honest opinion (in my honest opinion, that response was drafted by Bevan Brittan LLP), which was as follows:<br />
<br />
<i>&quot;I understand you have queried what the legal basis is for the Ombudsman using temporary staff to help us assess a backlog of housing cases. That authority is contained in Section 28 of the Local Government Act 1974 - and is simply an attempt for us to provide timely advice and support to people who are waiting to hear whether or not we will be proceeding to an in-depth investigation into their complaint. All of the decisions made were signed off by staff with delegated authority from the Ombudsman.&quot;</i><br />
<br />
In my honest opinion, the Ombudsman deliberately glossed over the following issues raised in my complaint:<br />
<br />
1) All casework of this kind managed by Bevan Brittan LLP carries legal professional privilege (&quot;LPP&quot;), and therefore cannot be subject to scrutiny from complainants, or indeed the judiciary. Accordingly, there is a lack of transparency.<br />
<br />
2) Bevan Brittan LLP would consider the Ombudsman as its client, and arguably the government, including local government, and is therefore not acting impartially. <br />
<br />
Evidently, the Ombudsman does not deny these allegations.<br />
<br />
The Ombudsman alleges that Bevan Brittan LLP's services are and were used to help it to assess a backlog of cases. I would take that with a pinch of salt in terms of their being any such backlog. Notwithstanding that, I think the word &quot;<i>assess</i>&quot; in this context is of profound concern. I take that to mean that that Bevan Brittan LLP is assessing how cases should be decided, if it is not, for all intents and purposes, making decisions on casework of this kind, whilst, of course, it is reasonable to believe they are not acting impartially for reasons aforesaid. <br />
<br />
I have sent the Ombudsman a letter before claim using the Judicial Review pre-action protocol, whilst trying to establish exactly what Bevan Brittan LLP have been doing in this regard. Today, I got a response back from Bevan Brittan LLP arguing that that information carries legal professional privilege.<br />
<br />
I am considering making a freedom of information request, but section 42 of Freedom of Information Act 2000 (&quot;FOIA&quot;) is problematic. I understand that this exemption is a qualified exemption, subject to the public interest test, meaning LPP can be overridden in the public interest and is not unchallengeable in the context of FOIA.<br />
<br />
Does anyone have any thoughts as to how best to make such a freedom of information request?<br />
<br />
Also, does anyone know how best to challenge (unlawful) conduct of this kind in terms of public law principles? <br />

First question: I asked my conveyancer to send me copies of the emails they've sent to the counterparty but they are not agreeing to do so (they say they're not allowed). Is this valid? Given they're representing me, I assume they should be able to send me anything they've sent on my behalf?<br />
<br />
Second question: I'm selling and we sent the draft contract and management pack to the buyer's solicitor 6th May. We still haven't received any legal enquiries 10 weeks later (although they have completed all the searches). In fact, as of two weeks ago, they hadn't even opened the zipped management pack. Even more worrying is that we think the buyer doesn't have financing in place yet (nearly 3 months into the process). As with the enquiries, we have repeatedly chased with clear direct questions but only ever get &quot;Will revert&quot; answers, if any.<br />
<br />
My concern is that either it's indicative of difficulty raising the money or, worse, its the preliminary stage of a gazundering strategy. Of course, it could just be very poor professional behaviour. To make things more complicated, when my estate agent has emailed the buyer about it, they got a very angry email back, saying just deal with the lawyer.<br />
<br />
Ideally, of course, the buyer can get finance and its just taking time but I dont want to wait for months and months only to find that they cant get the money and I have to start again back on the market.<br />
<br />
Would be very appreciative of any thoughts or advice.<br />

I'm working on an appeal / challenge for my Father in Law and any help would be appreciated.<br />

In April 2026 my Father in Law dropped his wife off in a street covered by a parking permit operated by NPM. As per their ANPR time stamps he was in the street for 2 minutes.<br />
<br />
We appealed the charge based on the grace period and the fact he didn't actually park the vehicle, which was declined and no further appeal can be granted.<br />
<br />
We missed the deadline to register it with IAS. Now Empira are chasing the collection of the full amount + £70. <br />
<br />

There is a volunteer that has been there for years and though not a bad person is not the saintly person so many take her to be.  If you say something mildly negative, the reply is something about not likely as she does so much volunteering and helping with fundraising.  I feel that she is self-important and entitled.  She has no formal responsibility or authority, though you'd be hard pressed to believe it by working with her.  She seems to have an &quot;in&quot; with most departments and gatekeeps a connection to donations of equipment of the disposable type, cups and the like.  I've seen her generally snooping around when areas are closed.  She has the attitude of feeling like she owns the place. I find this odd, that one person has been allowed to become like this, it's as if the several people she deals with haven't got together and realised.  Is this out of the ordinary or am I unnecessarily overconcerned?  I'm not sure what her reason is for this level of involvement other than a feeling of self-importance and grandeur for her own self-satisfactions in knowing and being able to give the impression of importance to friends and family.]]></content:encoded>
