Lowells - Help needed please

Hi Guys,

I'm afraid I need your help again.

I've received a letter today from Lowells regarding an old Capital one card. The letter states that I owe them £**** , but I'm pretty sure this most of this must be made up of charges for a start. The card limit was only £400 and I thought it had been paid off years ago.

The expiry date on the last card I had is 2004, I've never received a notice of assignment and this is the first letter I've received about it.

Not sure what to do next so any advice would be gratefully received.

As it's the first contact, File it under I and wait and see if they write again.

After all this may well be a phishing exercise..

Any idea when you last made a payment on this ?

Thanks for the speedy reply, Curlyben.

I think it would have been in 2004, but I don't have concrete proof. In those days I rather foolishly didn't keep all my bank statements. I have found one statement from 2003 where I paid them over £100 pounds, but that's the last I can find, but I know for definite it wouldn't have been after 2004.

Thanks for the advice, I'll wait and see if they write back, I don't mind paying if I do owe them anything, but it can't be anywhere near the amount they are claiming.

That being the case we need to ensure they have the legal rights to demand payment anyway.
I looks like they are scraping the bottom of the barrel and going for a Statute barred debt anyway, as it's over 6 years since the last payment.

No matter that can wait, for now you have nowt to say to them..

Just an update on this. This morning I've received a Statement of Account.

Details:
Statement date - 09/11/2011
Period covered - 01/10/2008 to 31/10/2011

Your account summary
Opening Balance on 01/10/2008 - ****
Total payments received - £-10
Balance adjustments - £0.00
Fees and charges - £0.00
Closing balance on 31/10/2011 - £****

It also says - Credit agreement dated: 08/02/2000

On the back of the letter it says

Opening balance £****
October 10 - Payment - Thank you -10
Returned Payments - £****
Balance adjustments - £0.00
Fees and charges - £0.00
Total Transactions - Credits -10.00
Closing Balance - £****

I don't know what year the above alledged payment of £10 is supposed to be as it doesn't say.

Any help with my next steps would be gratefully received.

Ignore it, but file that alleged "statement" carefully.

They might eventually stop playing at Silly Buggers.

If you are short of toilet paper then that's all the legitimacy that "statement" has in reality - Lowells are just deluded

Just a note of caution
If you are claiming this is statute barred, then you must ensure that you do not acknowledge the debt in any correspondence, if you must contact them then always refer to the” alleged” debt.
Also the barr will run from the cause of action, in other words when the account was defaulted, this may be a significantly later than the date you made your last payment.
