  • Defamation by NHS dentist

I was refused treatment twice by a dental surgery purely due to discrimination and made a formal complaint to NHS England. However, the surgery changed their excuse for not treating me from my reporting a patient to the police for making a hate motivated gesture at me to falsely claiming I was intimidating and aggressive. NHS England seemed satisfied with their response and suggested I contact the Health Ombudsman. As the surgery staff were so hostile toward me I actually recorded my visits to the surgery on an audio recorder and this proves their claims I was abusive as malicious falsehoods and also confirms they agreed to refund my examination fee, which of course they didn't. I am considering action under The Equality Act 2010 and a claim in the Small Claims Court. I have had some experience of the latter through running a business many years ago and having had a couple of customers reluctant to part with my fees but am out of my depth re; The Equality Act. Would I be allowed to present my audio evidence be in court? Otherwise it would be their words against mine.
    Many thanks.
