  • Used car right to return help

Hi i purchased a 3 year old jeep with 22k miles on it from a large garage chain on 8/7/17 after viewing and a short test drive i paid an initial deposit of £5000 and the dealer arranged finance on a pcp agreement for the remaining £12000 over 48 months reliability is essential to me so i had opted for an additional 2 years warranty on the car as well. The car is at the extreme end of my budget but i had hoped by buying relatively new with low miles i would have at least some worry free motoring but the day after delivery i poped the bonnet to fill the screen wash only to discover that it had clearly had some sort of rodent living under the bonnet. I contacted the dealer who explained it must have happened in the short time it was on the forecourt but i find this hard to believe asit looked like it had been in there a while.
The dealer agreed to give the engine bay a good clean and i had hoped this would be the end of the matter but this earning (one week after purchase ) i have notice a small pool of oil ware i had parked it. I accept that it is not a new car but i have absolutely no confidence in the vehicle already and am wondering what my rights would be to return and regect the car . I would greatly appreciate anyone's thoughts or advice on the matter. Thanks

Re: Used car right to return help

Tquick update the car has developed a intermittent fault which puts a oil light on and also one fog light. I have spoken to the finance company who agreed it was unacceptable but couldent advise if i could just hand the car back to the dealer for a refund. The dealer has offered to pick the car up and resolve any issues but my dilemma is that once thes are fixed i will still be left with a car that is just patched up and clearly has underlying faults. Am i obligated to give them opportunity to fix it or can i ask for a full refund as i am under the 30 days. I would really appreciate anyone's opinion or advice thanks

As it's within 30 days your could write to the dealer rejecting the car as it is not of satisfactory quality. This is under the Consumer Rights Act 2015

Thanks for the reply ostell. That was my understanding but the dealer has just informed me that i have to give them a opportunity to fix it before I can take it further . I am reluctant to even do this as it is just a stall tactic that at best will leave me with a car that is just waiting on the next issue to pop up.

Within the first 30 days there is no right of repair. He either hasn't read the CRA or he's thinking of the old sale of goods. Afterr the 30 days, and up to 6 months, he does have the right of 1 repair attempt. Get that rejection letter in now so that you are within the 30 days. Perhaps this will help with the quick explanations, Or the regulations themselves

Thats really useful ostel there are so many conflicting answers online im glad i fould this site.. i am going to inform them and the finance company of my intent to reject and get the letter with photographs of the issues sent to the dealers head office.
Hopefully that will get them to resolve it quickly enough and gove me a refund but should i be expected to pay any sort of compensation to them for the weeks use i have had of the car ?

Just get those letters in pronto so that you don't miss the 30 days.

You would be expected to pay something for the use of the car but don't offer and see what happens, it can't be a lot. You can also claim for your extra costs caused by the problems.

The deduction for use only applies if the final right to reject a motor vehicle is exercised.(CRA 2015 sec24 (8) (9) &(10)
The trader cannot make such a deduction if the short term right is exercised

Can't thank you all enough. I may even get some sleep tonight for the first time since this saga started.
