    Hi All

    I booked a holiday away for two weeks in Devon at a caravan park back in January, due to my wife and son losing there jobs I have had to cancel the holiday. The booking was on a promotional deposit of £30. I was told when I cancelled the holiday the cancelation team would be contacting me to pay the rest of the deposit as the promotional deposit was only valid if I paid for the rest of the holiday so I now allegedly owe them an extra £170. I told them I would not pay this amount as I classed a deposit as just that and that no further monies would be paid. I have been receiving letters from a company with a different name saying that I need to pay this amount and today received a 14 Day before court letter saying that I if I did not pay they would take legal action and add interest and costs to the amount.

      What paperwork did you get when you booked?
      Can you post it up or give us a link to a website

      A copy of the current chasing letters might also be useful.

      Name of the company you booked with, and the company now chasing you please

          Sorry for the delay I am in the process of moving my business to new premises.

          The web site I booked this through is http://www.hoseasons.co.uk/holiday-parks/ . The company is hoseasons By WYndom Vacation Rentals.

          I have recived a county court claim today from Wyndom Claiming the amout of 170.00 + 25 Court Fees Claiming that they had done all to settle the matter if you can call threatening letters all you can do.

          They are claiming that the deposit was offered within their low deposit terms but do not state what these are. and that the insurance does not cover as we cancelled due to two family members losing their jobs so we could no longer afford this holiday.

          The invoice attached makes no reference to low deposit or the fact that should I cancel I will have to pay a further deposit of £170 in fact it makes no mention of any amount that will have to be paid. it just askes me to read their terms and conditions

                Invoice does state this
                You have booked under a low deposit promotional
                offer.Please see booking conditions (particularly the clauses
                regarding cancellation and payment) for details.
                How much would the standard deposit have been ? £200 ?
                Did you receive email confirmation at the time of booking - and does that have links to these terms in etc ?

                UK Lodges and Parks

                The following terms and conditions apply to new Hoseasons Lodges & Parks bookings in the UK, that are booked on or before 24/04/17 for departures between 01/01/17 and 31/12/17.
                1. The low deposit under this offer is £50 per booking.
                2. The difference between the £50 low deposit and the usual deposit shown in our brochure and on our website must be paid with the balance payment, which we must receive no later than 8 weeks before your booking starts
                3. If you cancel your booking you must pay the difference between the low deposit and the usual deposit, plus any booking fee and any travel insurance premiums due, either at the time the balance of your booking is due or, if you cancel, at the time you cancel the booking. If you cancel, you must also pay all other cancellation charges which may apply.
                4. If you do not pay what you owe on time, we can treat your booking as cancelled by you for a non-refundable reason. If this happens you will be responsible for the difference between the low deposit and the usual deposit, plus any booking fee and any travel insurance premiums due and any cancellation charges which may apply.
                5. The closing date for this low deposit offer is 24/04/17. We can decide to extend or withdraw this offer depending on popularity and park availability.

                  So can you post a copy of the Particulars of Claim from the claim form please.

                  You also need to log in to Moneyclaim online as per instructions on the claim form and ACKNOWLEDGE the claim with intent to defend in full. Do not enter your defence at this time. You do not wish to contend jurisdiction.

                  Once that's done you can get a couple letters off to Hoseasons to get evidence of their claim, but need to know everything you have - email / letters etc regarding the booking and the complaint/case so far.

                  They do just seem to be claiming the difference in deposit at least, not the whole holiday.

                    Oh [MENTION=28095]belgarion21[/MENTION] also your insurance docs. Though I think as this is just regards the difference in deposit the insurance will be irrelevant, still best to check
