    I had a payday loan going back to 2012 which was with Minicredit who subsequently went out of business in 2014. I owed £100 and fell behind with payments and had other loans which since the FOS intervened were written off. But kapama / Opos have been chasing it. The debt rose to £1600 but when the adjudicator intervened it was reduced to £200. However they refuse to remove the default and I am challenging it because Minicredit never issued one. Kapama have been very i difficult refusing to remove it. I have now threatened to go the full way to the ombudsman. Should a default have been sent to me? Any help appreciated thanks

        The argument is usually that the interest has been removed from the loan because it was unaffordable and irresponsible lending. So it is unreasonable that your credit record should be harmed for a loan you should never have been given.

        It is good practice for a lender to tell you when a default is being added to your credit record but there is no legal requirement for this to happen.

          Thank you Sarah. I always thought there was 2 stages pre default being sent to help the debtor rectify arrears within a time limit then default issued.
