  • Please help: Moriarty Law threatening court action for 4 year old quickquid debt.

    Hello.

    As you can probably surmise this is my first time on this forum and after being bombarded by letter after letter it has come to the point of legal threats.

    Long story short is around 4-5 years ago I was in a steady job, albeit minimum wage. Eventually come the point that payday loans had to be used and eventually got into a bit of a pickle. I was massively bereaved by the departure of my mother and this affected my attendance at work so inevitably once the redundancies came my bradford score was one of the worst, didn't have the money to go to a tribunal let alone pay off the mounting debts.

    After getting back into work and back on my feet, the debt interest accompanied by my stubbornness has now lead to quick quid referring the debt to collectors and here is where we are today. £805.82 and a letter that threatens my debt increasing up to £1,000.28.

    So basically I am now being threatened with court action, I know that morally it is within my best interests to pay the debt off but this is not financially viable at this point in time, as you can appreciate I am a bit of a novice in this area so any insight on this would be appreciative.

    What are the chances of this actually going to court?, are these reasonable people or are they strictly out to get as much as they can out of me? What options do I have?

          Hi & welcome to LB.

          You've received a letter before claim, which requires a response, ideally within the stated timeframe.

          Before doing so, a bit more info on this might help.

          Were there multiple loans which were 'rolled over'? (a new loan to pay off an existing one).

          Were QQ aware of your financial difficulties at the time?

            Thanks for your reply. Yes there is atleast 3 or 4 including catalogues and credit cards.

            Some of these were done under fraud as my brothers are drug addicts and used my name to acquire goods and money but this is classed as friendly fraud?? I am still liable though apparently regardless of my attempts to discuss this with each of the companies. I know it sounds completely farfetched and I assume this is why the lenders failed to take this into consideration. However the debt in question is legitimately on my own accord.

            So I would say that they are aware now but not at the point of receipt as it was just a subtle attempt of covering the previous debts.

            I havent paid any of these companies a penny for atleast 2 or 3 years because it really did get me down and I just hoped they would go away, but it appears they are all comming back with vengeance.

            Non performing debts?? Im sorry does this mean that they buy debts that are without the relative paperwork??

              What matters is not so much your other debts but whether you borrowed from QQ for many months, either by rolling loans or repaying them borrowing again. If you did, you probably have got a good "affordability" complaint. Read https://debtcamel.co.uk/payday-loan-refunds/ and decide if you want to complain. If you only borrowed for a couple of months this is unlikely to be worth bothering with.

              If you do want to complain, you need to get your complaint into QQ asap. That means today And go straight to step two, full complaint, you don't have time to do the step one first, you need to get a proper complaint into to put a halt to this enforcement.

              If you complain, immediately inform MMF and MoriatyLaw that you are disputing the debt with QuickQuid and ask them to put a hold on any enforcement action until the complaint is resolved.

              If you decide you don't want to complain, then you need to make an arrangement to pay the debt or they are very likely to go to court for a CCJ.

              You also need to look at the rest of your finances. Because you are going to be getting more letters about your other debts. How much do all the others add up to? If you borrowed a lot from other payday lenders, you could start complaints about those - these are better done now not when legal action is being threatened. But if you have lots of other debts as well and you are out of work and renting, you should probably be looking ta more comprehensive solutions such as a debt relief order if your debts are under £20,000. If you think a DRO sounds good, then go for that now because it will get rid of ALL your debts and you won't have to bother with payday loan complaints and fighting court cases.

                Ok thank you so much for your help. It is maybe worth noting that this debt was under 'Flexi-Credit' which I hope would add substance to an affordability complaint.

                With corrospondance is it always best to send letters via recorded delivery or in this case will phonecalls suffice??

                Also I read alot about stay of execution and prove it letters ect, are any of these relevant to my current situation or is this a more hardcore way of dealing with it??

                  Ok so I have put my affordability complaint in an email to Quick Quid and ive tried to leave out the sob story and just go straight in with the facts. I have posted a letter recorded delivery also for good measure.

                  MMF and Moriartylaw also have letters on the way asking for them to postpone any further action untill the dispute is resolved.

                  I am just woundering, are the collectors and solicitors legally obliged to wait untill the dispute has been dealt with before they can continue or is it generally a gesture of good will?? Also if Moriartylaw wanted to, are they still able to take this debt to the high court to apply for a writ regardless of my dispute with Quick Quid??
