    Hi my wife has received a claim form from a company called Interhigh Education,

    This has originated from my wife looking at getting our daughter better education than she was currently getting, after paying a deposit of £50 on the 9th May 2016, my wife decided that we wouldn't be able to pay the fees, so when they requested a confirmation of accepting the place for her with a £200 refundable deposit she decided not to go forward with the place.

    My wife had assumed that was the end of it as we have never heard or received any paperwork, educational supplies absolutely nothing at all from them.

    Here are the particulars of the claim:

    By a contract dated 16/05/2016, the claimant agreed with the defendant to provide education services to the defendants daughter named ****** **** at an annual cost of £2520. The claimant has rendered invoices to the defendant in the amounts of £1680, but despite demands these have remained unpaid, The claimant therefore seeks payment of the sum of £1680 together with interest calculated at 8% from 31/01/2017 to 12/04/2017, continuing thereafter at a daily rate of 37p.
    The claiment claims interest under section 69 of the county courts act 1984 at the rate 8% per year from 31/01/2017 to 12/04/2017 on £1680 and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of 37p.

    Registration

    Registration Fee £50 per child
    There is a non-returnable Registration Fee of £50 per child payable upon submission of the Application Form.
    Confirmation of Entry Fee

    Fee Deposit £150
    When a place is accepted a deposit of £200 is payable to the School. The deposit will be returned after the child’s final term at the school and any outstanding fees and other charges have been paid and in the case of children who are taking public examinations upon receipt by the school of a copy and the exam result(s). If a place is cancelled by the parent after acceptance but before the child starts school the deposit is not refundable.

    so ... your wife didn't send back confirmation of acceptance for the offered place?? I can't see how they can take you to court if you didn't officially accept the place

    You should acknowledge service of the claim via MCOL and tick 'defend in full'
    A cca request might be an idea (ask for the signed contract)
    and a cpr - you can ask for the contract and the invoices

        I'm not sure a s. 77-79 Consumer Credit Act Request will help you unless the school was offering your wife credit not simply invoicing her on a term-by-term basis payable in advance which seems to be the case if the POC are to be believed (and from looking at their website).

        However they would have to produce the contract which they intend to rely on which was unlikely to have been regulated by the CCA (ditto any request for the Default Notice if there was no credit involved).

          When you say your wife "decided not to go forward with the place" did she actively do anything or was she sent a contract (confirmation of accepting) which said it was deemed to be accepted after 14 days if not cancelled?

          Did the school send any educational materials by email etc or did your daughter interact with the school online in any way?

              Hi Di,

              I've spoken to my wife and see doesn't remember any contract being sent via email, certainly nothing by post, no materials have been sent to us and our daughter didn't know anything about the school so has made no contact at all.

                Yes, but you must read, understand and edit it before you send it (i.e. remove the paragraph that states you've sent a CCA Request or you'll look foolish )

                Has the school instructed solicitors to manage the claim?

                  Can you also confirm that the business did not provide any credit to your wife (they're not regulated by the FCA so I doubt it).

                    Yes that's the company, and no everything had to be paid upfront. there are no solicitors involved, the documents and payments name and address are: Interhigh Education, Lewis Parry House, Elvicta Est, Crickhowell, Powys, NP8 1DF.

                      I think I'd draft a letter from scratch and include in it a request for documents mentioned in the particulars of claim ( invoices and contract) and I'd also be inclined to request details of when / how the £200 desposit was paid and any communication regarding acceptance of a place, and point out that you have never used the service beyond the initial enquiry and £50 application fee.

                      How did they request this - via email or letter ? Can your wife go back through her emails and find anything related to Interhigh. Also has she checked her bank that the £200 wasn't taken (eg if she somehow signed up to a continuous payment authority etc ) - and check the address that was given on the application form if you kept a copy - was that online ? email ? or paper ?
